These Terms of Service define your limitations, legal rights, and obligations with regard to your use of and participation in the website, including classified advertisements, forums, various email functions and internet links, and all content and services accessible through the domain and sub-domains of www. bimadhan.com (hereinafter referred to as the “Website”), and (ii) the online transactions between those users of the Website who are offering services of settlement of unmet needs of mistreated Insurance Policy Holders (also referred to as a “Service Providers”) and those users of the Website who are obtaining services of Service Provider by getting their grievance resolved by the Service Provider (referred to as a “Service User”) through the Website (such services, collectively, the “Service”). The following Terms of Service integrate the Privacy Statement and apply to all Website users, including those who contribute video content, information, private and public messages, ads, and other materials or Services.

You acknowledge that the Website serves as a platform for Service Providers and Service Users to agree upon Services, and by using, visiting, registering for, and/or otherwise participating in this Website, including the Services presented, promoted, and displayed on the Website, you hereby certify that: (1) you are either a Service Provider or a prospective Service User, (2) you have the authority to enter into these Terms of Use, (3) you authorise the transfer of your personal information to the Website, and (4) you consent to the transfer of If you do not agree to the aforementioned terms, you may not access or use this website. Bimadhan.com reserves the right, in its sole discretion, to change, modify, or otherwise amend the Terms of Use, and any other documents incorporated by reference herein for complying with legal and regulatory framework and for other legitimate business purposes, at any time, and will post notice of the changes and the amended terms of use on the Terms & Conditions page of the Website. You are responsible for reviewing the Terms of Service for any modifications, and you are encouraged to do so periodically. Your continued use of the Website after any modification to these Terms of Service indicates your agreement and acceptance of the updated terms. Affiliation and Accessibility

Membership Eligibility Criteria

You clearly understand and accept that you, and not Bimadhan.com, will be responsible for any losses, damages, etc. (direct or indirect) resulting from the unauthorised use of your Account. Despite the foregoing, you may be liable for Bimadhan.com’s or others’ losses resulting from such illegal use.
A Client or Account Holder may be referred to as a “User” at times.
You agree to adhere to the following policies (the “Account Policies”):
You may not copy or distribute any portion of the Site in any way without Bimadhan.com’s prior written consent.
You will not alter or modify any portion of the Website beyond what is reasonable for using the Website for its intended purpose.
You will provide true, accurate, current, and complete information when creating your Account, and you will maintain and update this information over the period of this Agreement so that it remains accurate, true, and complete.
You shall not collect Service Provider or Service User information, including but not limited to names, addresses, phone numbers, or email addresses, copyrighted text, or otherwise misuse or misappropriate Website information or content, including but not limited to use on a “mirrored”, competitive, or third-party site.
You may not send more request messages to the Bimadhan.com servers or any server of an Bimadhan.com subsidiary or affiliate than a human can reasonably produce in the same time period by using a conventional online web browser; provided, however, that the operators of public search engines may use spiders or robots to copy materials from the site for the sole purpose of creating publicly available searchable indices of the materials. Bimadhan.com retains the right to cancel these exceptions on a general or case-by-case basis.
You shall not take any action that (i) unreasonably encumbers or, in Bimadhan.com’s sole discretion, may unreasonably encumber the Website /Firm’s Website’s infrastructure; (ii) interferes or attempts to interfere with the proper working of the Firm/ Website or any third-party participation in the Website; or (iii) circumvents Bimadhan.com’s measures used to prevent or restrict access to the Website.
You agree not to collect or harvest any personally identifiable information, including, but not limited to, names or other Account information, from the Site, nor to utilise the communication tools provided by the Site for any commercial soliciting reasons.
You consent and authorise us to store all necessary correspondence from your email account that assists us in settling/resolving your insurance claim.
Your access to, use of, and participation on the Website are subject to the Terms of Service and Bimadhan.com’s regulations, guidelines, and additional policies, which Bimadhan.com may establish from time to time, including, without limitation, a copyright policy and any other restrictions or limitations that Bimadhan.com publishes on the Website (the “Additional Policies”). You agree to comply at all times with the Additional Policies and your obligations thereunder. You hereby acknowledge and agree that if you fail to comply with any of the terms and conditions of this Agreement or documents referred to herein, including the Account Policies, membership eligibility criteria, or Additional Policies, Bimadhan.com, in its sole discretion, may terminate your Account at any time without prior notice to you and initiate appropriate legal action, if necessary.
Restrictions for Service Users
SERVICE USERS MAY NOT TAKE ANY OF THE FOLLOWING ACTIONS: (a) commit to using a Service without paying; (b) sign up for, commit to a price for, use, or otherwise solicit a Service with no intention of following through on your use of or payment for the Service; (c) agree to purchase a Service when you do not meet the Service Provider’s terms as outlined in the Posting, or agree to purchase a Service with the intention of disrupting a Post
If a Service User violates any of the aforementioned rules, Bimadhan.com, in its sole discretion, may take any of the following actions: (a) limit the Service User’s Account privileges; (b) suspend the Service User’s Account; and/or (c) reduce the Service User’s status earned via the Feedback page.
You hereby release Bimadhan.com, its proprietor, officers, directors, agents, and employees from any and all claims, demands, and damages (actual and consequential) of any kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to the disputed insurance claim.
We shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to have been caused by or in connection with the use of the Website’s service. We neither guarantee nor assume responsibility for your satisfaction with the service provided.
If a claim emerges after we have delivered the needed service, we are not liable. Once the requested service has been supplied in full, you and we are no longer in any relationship with regard to it.
Regarding your use of the Website, you bear all liability and risk. You acknowledge and agree that, to the fullest extent permitted by law, we disclaim all warranties, representations, and endorsements, whether express or implied, with respect to the website, including, without limitation, implied warranties of title, merchantability, non-infringement, and fitness for a particular purpose. We are not required to update or change the Website, and our failure to do so is not our responsibility. In no event, under no legal or equitable theory (whether tort, contract, strict liability or otherwise), shall we or any of our respective employees, directors, officers, agents or affiliates be liable hereunder or otherwise for any loss or damage of any kind, direct or indirect, in connection with or arising from the Website, the use of the Website, or our agreement with you regarding the Website, including, but not limited to, compensatory, direct, consequential, incisive, special, punitive, or other damages.
In connection with these terms, we shall not be liable for any indirect, consequential, incidental, exemplary, or special damages, regardless of the cause. Despite the foregoing, the maximum aggregate liability of Bimadhan (whether in contract, tort (including negligence)) shall be limited to Rs. 5,000 (Rupees Five Thousand Only) for all losses arising out of or in connection with these conditions, regardless of the mode of action. No claim may be filed against Bimadhan more than one (1) year after the facts giving rise to the claim have occurred. The preceding limitations of liability and exclusions of damages in this clause limitation of liability constitute an essential basis for these conditions and shall apply regardless of the failure of essential purpose of any limited warranty or remedy contained herein.
Limitation of Service Provider’s Liability – Bimadhan.com shall not be liable for a delay in performance of the service that is reasonable. The reasonableness will be decided on a case-by-case basis, but such delays will typically be the consequence of circumstances beyond the Service Provider’s control.
Force Majeure – We shall not be liable if the service is delayed due to any force majeure event, which includes, but is not limited to, fire, flood, earthquakes, strikes, unavailability of essential utilities, blackout, acts of God, acts of declared or undeclared war, acts of regulatory agencies, or natural disaster.
Copyright Infringement Take Down Procedure – Bimadhan.com has a high regard for intellectual property and expects its users to uphold the same standard. Bimadhan.com may, in appropriate circumstances and at its sole discretion, terminate the Account or ban access to the Website for users who violate the intellectual property rights of others.
If you feel that your work has been duplicated and displayed on the Website in violation of your copyright and/or trademark, please contact us at [email protected] with the following information:
(i) identification of the allegedly infringing copyrighted and/or trademarked work or, if numerous works at a single online site are covered by a single notification, a representative list of such works at that site;
(ii) identification of the material alleged to be infringing or to be the subject of infringing conduct and information reasonably sufficient to facilitate Bimadhan.com to locate the material;
(iii) a declaration in writing that you believe the disputed use is not allowed by the copyright and/or trademark owner, its agent, or the law;
(iv) information reasonably sufficient to authorise Bimadhan.com to contact you as the complaining party, such as your address, telephone number, and, if available, your e-mail address;
(v) the electronic or physical signature of the individual authorised to act on behalf of the owner of the allegedly infringed exclusive interest; and
(vi) a statement by you, made under penalty of perjury, that the information in your report is accurate and that you are the owner of the exclusive right or are authorised to act on the owner’s behalf. This document refers to as the “Notice” your statement comprising the aforementioned items.
Only the owner of intellectual property rights may report potentially infringing content via the above-described reporting system of Bimadhan.com. If you are not the owner of the intellectual property rights, you must contact the owner of the intellectual property rights, who will decide whether to follow the processes outlined in these terms of service.
Alterations or Discontinuation of Website
Bimadhan reserves the right at any time and from time to time, with or without notice and at its sole discretion, to modify or discontinue, temporarily or permanently, the Website (or any portion thereof). You agree that Bimadhan is not liable to you or any third person for any change, suspension, or discontinuance of its services.
You hereby acknowledge and agree that Bimadhan.com, in its sole and absolute discretion, has the right (but not the obligation) to delete, terminate, or deactivate your Account, block your email or IP address, cancel the authorization or otherwise terminate your access to or participation in the use of the Website (or any part thereof), or remove and discard any Submitted Content on the Website (“Termination of Service”), with or without cause.
You may cancel your use of the website and/or terminate the terms of the use at any time by following the link to deactive your account in your account or you may simply write to [email protected] or send a letter to our registered office.
Effect of termination
Upon termination of your Account, your right to participate in the Website, including, but not limited to, your right to offer or purchase services, and your right to receive any fees or compensation, including, but not limited to, referral discounts, incentive bonuses, or other special offer rewards, shall terminate automatically. You understand and agree that your right to receive any fees or payments pursuant to this Agreement is contingent upon your appropriate use of the Website, your adherence to the Terms of Service, the continuing activation of your Account, and your permitted participation on the Website. In the event of Service Termination, your Account will be terminated and you may no longer have access to it or any files or other data included within it. Despite the foregoing, residual data may persist in the system of Bimadhan.com.
Unless Bimadhan.com has previously cancelled or terminated your use of the Website (in which case subsequent notice is not required), if you provided a valid email address during registration, Bimadhan.com will notify you via email of any such termination or cancellation, which shall be effective immediately upon Bimadhan.com’s delivery of such notice.
Upon Termination of Service, the following shall occur: all licences granted to you under this Agreement shall cease immediately, and you shall destroy all copies of Bimadhan.com’s Data (as defined below), Marks (as defined below), and other content in your possession or control. You further understand and agree that Bimadhan.com shall have no liability to you or any third party for any termination of your access to the Website. Upon Termination of Service, Bimadhan.com retains the right to use any data collected from your use of the Website for internal analysis and archival purposes, and all licences you have granted Bimadhan.com pursuant to this Agreement shall continue to be valid for the aforementioned purpose.
You agree to indemnify and hold harmless Bimadhan.com and its officers, managers, members, affiliates, successor, assigns, directors, agents, Service Providers, and suppliers from any claim or demand, including reasonable attorney’s fees and court costs, made by a third party due to or arising from the Termination of Service.
Rights to intellectual property
Bimadhan.com owns or holds licences to all Data and Marks on the Website, including, but not limited to, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like (the “Data”) and trademarks, service marks, and logos contained therein (the “Marks”). Other trademarks, brands, and logos included on this website belong to their respective owners.
Data on the Website is provided “as is” for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcasted, displayed, sold, licenced, or otherwise exploited for any other purposes without the express written permission of the respective owners. Bimadhan.com maintains all rights not expressly granted with respect to the Website and the Data.
You agree not to use, copy, or distribute any of the Data except as specifically permitted above, including any commercial use, copying, or distribution of content received via the Website. When downloading or printing a copy of the Data for your own personal use, you must keep all copyright and proprietary notices intact. You undertake not to circumvent, deactivate, or otherwise interfere with the Website’s security features or those that prevent or restrict use or copying of any Data or enforce use limitations on the Website or the Data therein.
The Website contains Bimadhan.com’s Data and Marks, which are, or may become, protected by copyright, trademark, patent, trade secret and other laws, and Bimadhan.com owns and retains all rights in its Data and Marks. Bimadhan.com now provides you a limited, revocable, non-transferable, and non-sublicensable licence to reproduce and display the Bimadhan.com Data (excluding any software source code) only for your personal use in connection with accessing and using the Website.
The Website may include contain Data belonging to other users or licensors, which you are prohibited from copying, modifying, translating, publishing, broadcasting, transmitting, distributing, performing, displaying, or selling.
Governing Law and Dispute Resolution
This Agreement shall be governed and construed in accordance with Indian law, excluding its conflict of laws provisions.
If a dispute arises out of or relates to this Agreement or its performance, legality, or enforceability (a “Dispute”), the parties shall follow the method outlined in this Clause:
(i) Either Party must provide the other with written notice of the Dispute, setting forth the nature and full particulars of the Dispute (“Dispute Notice”), along with any applicable supporting documentation. Upon service of the Notice of Dispute, the Parties shall try to resolve the Dispute in good faith.
(ii) If the Parties are unable to resolve the Dispute within thirty (30) days after service of the Dispute Notice, either Party may submit the Dispute to arbitration by a sole arbitrator in accordance with the Arbitration and Conciliation Act, 1996. The arbitration will take place in Delhi, and the language will be English. In the event that the Parties are unable to agree on a sole arbitrator within thirty (30) days of receipt of a request by one Party from the other Party to do so, the appointment shall be made, upon the request of a Party, by the Chief Justice of the High Court or any person or institution designated by him, pursuant to Section 11(5) of the Arbitration and Conciliation Act, 1996.
Except as otherwise provided above, all disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts in Delhi, to which the Parties irrevocably submit.
Indemnification
Each Party agrees to defend, indemnify, and hold harmless the other Party, its subsidiaries, affiliates, agents, officers, employees, and assigns on a full indemnity basis, from and against all actions, proceedings, claims, demands, costs (including legal fees), damages, judgments, decrees, expenses, penalties, and liabilities of any kind or nature whatsoever arising directly or indirectly as a result of any breach or non-performance by such Party of its obligations under this Agreement.
You shall indemnify the Service Professional for any litigation or legal action arising from your failure to comply with the Service Professional’s responsibilities under the terms of this Agreement. You shall indemnify us for any delay or inability to perform Services for which we were required to indemnify the Service user for losses incurred. You shall indemnify us in the event that we violate any relevant federal, state, or local law or regulation owing to your or your Services’ negligence.
This Clause survives any termination or rejection of the Agreement.
Cancellation and Refund Policies
You may cancel your registration and use of the Website at any time, with or without cause, by following the link to deactivate your account in your Account.
In the event of any unusual deductions of funds from your wallet/account, even if you have not used the service or have been overcharged, the amount will be refunded upon receipt of a complaint from you or upon detection of such transactions by the Bimadhan.com management, whichever occurs first.
Notification
You agree that Bimadhan.com may send you notices, including those regarding changes to the Terms of Service, via email, regular mail, or website postings.
Basic Information
1. TERMS OF USE IN THEIR ENTIRETY – The Terms of Use, along with the Privacy Policy and any other legal notices or Additional Policies published by Bimadhan.com on the Website, shall comprise the entire agreement between you and Bimadhan.com regarding the Website. In the event that any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the validity of the remaining provisions shall not be affected.
Bimadhan.com’s failure to assert a right or provision under these Terms of Use shall not be construed as a waiver of such right or provision.
2. You agree that any cause of claim arising out of or in connection with the Website must commence within one (1) year after the cause of action accrues. If not, the cause of action is forever barred.
3. The section headings in the Terms of Service are merely for convenience and have no legal or contractual significance.
The Firm maintains the right to use customer/client evaluations and testimonials for the purpose of increasing brand awareness and promoting the Firm/website.
